⚡Indictment Filed Against Sanctioned ‘Judge’ for Unlawful Deportation from Occupied Crimea ⚖️The Prosecutor’s Office of the Autonomous Republic of Crimea and the City of Sevastopol has filed an indictment against a judge of the illegitimate “Alushta City Court of the Republic of Crimea.” 🔹Following the occupation of the peninsula, the accused voluntarily assumed a judicial position within the occupation administration and facilitated the implementation of policies aimed at altering Crimea's demographic composition. 🔹The investigation has established that, in direct violation of the protected status of civilians under international humanitarian law, the accused issued an unlawful decision resulting in the deportation of a Ukrainian citizen from Crimea. 🔹The purported grounds for this expulsion were the “lack of residence permits for the territory of the Russian Federation.” In reality, the victim was coerced into leaving the peninsula due to their refusal to obtain documentation issued by the occupying state. 🔹It should be noted that Ukrainian citizens residing in the occupied territory do not require additional permits to remain in their homes. 🔹The actions of the accused constitute a severe violation of Articles 49 and 147 of the 1949 Geneva Convention relative to the Protection of Civilian Persons in Time of War, which prohibits individual or mass deportation of protected persons from occupied territory, regardless of motive. 🔹The prosecution has classified these actions as a war crime under Article 438, Part 1 of the Criminal Code of Ukraine. If convicted, the accused faces a potential sentence of up to 12 years of imprisonment. 🔹Furthermore, in 2024, the National Security and Defence Council of Ukraine imposed personal special economic and other restrictive measures (sanctions) against the accused. ❗A special pretrial investigation was conducted by the Main Directorate of the Security Service of Ukraine in the Autonomous Republic of Crimea. 📌Article 62 of the Constitution of Ukraine states that a person shall be presumed innocent of committing a crime and shall not be subjected to criminal punishment until his/her guilt is proved through a legal procedure and established by a court verdict of guilty.
